1 Application of Conditions
All and any business undertaken by Centre Tank Services (The Company) is transacted subject to the following conditions. No addition to or variation of or exclusion of these conditions or any of them (whether contained in any official order form from any Customer or otherwise shall be binding unless such addition variation or exclusion has been expressly and specifically accepted in writing by the company. Orders accepted by the Company may not be cancelled under any circumstances unless agreed in writing by the Company. Cancellation of goods ordered to a customer's own specification will not be accepted.

2 Delivery
Delivery promises are made in good faith and every effort will be made to maintain such promises but no guarantee as to the rate or time of delivery is given or may be implied and we cannot accept responsibility for any direct or indirect loss arising from such delivery delays.

3 Prices
Prices shown on quotation or acknowledgments of orders are subject to alteration or withdrawal without notice. Owing to fluctuations in the cost of materials the company reserve the right to charge the prices ruling at the date of despatch. All prices quoted are exclusive of Value Added Tax, which will be charged at the rate applicable on the date of despatch.

4 Claims for Damage, Shortage or Loss
No claim for damage in transit, shortage of delivery loss of goods in transit can be accepted unless separate notice in writing is given to the carrier concerned and the Company within 7 days of receipt of goods.

5 Determination of Contract
The Company shall have the right forthwith to determine any contract then subsisting and upon written notice of such determination being posted to the customers last known address any subsisting contracts shall be deemed to have been determined without prejudice to any claim or right the Company might otherwise make or exercise.

6 Return of Goods
Once goods are dispatched they are not returnable without our written consent and to cover expenses a charge of 20% of the value of goods shall be levied.

7 Technical Advice
The Company at the request of a customer may, but without being under any obligation to do so, furnish technical advice with reference to the use of the goods or materials sold hereunder, but on the express understanding that any such advice or assistance is given and accepted at the customer's risk and the Company shall not be liable for any loss damage or claims arising there from.

8 Errors or Omissions
Errors or omissions are subject to correction.

9 Waste Electrical and Electronic Equipment Regulations 2006
The Purchaser shall be responsible for the costs of collection, treatment, recovery and environmentally sound disposal of the Product and Replaced Product in accordance with the Regulations.

The Purchaser shall not dispose of the Product or the Replaced Product other than in accordance with the Regulations.

The Purchaser agrees to indemnify and keep indemnified the Seller from and against any and all loss damage or liability (whether criminal or civil) suffered and legal fees and costs incurred by the Seller resulting from a breach of this clause.

**"Replaced Product" means any product that is intended to be replaced by the Product.

10 Passing of Risk and Retention of Title
Property in the goods shall not pass to the purchaser until the full invoice price is paid under this or any other contract with the Company. Until such price is paid in full goods held in the buyer's possession are held by him as bailee on the Company's behalf. Full terms and conditions on request.

11 Legal Actions
Any disputes between Centre Tank Services are to be heard in the United Kingdom and under English Law.

Warranty

Centre Tank Services Warranty is one year from the date of the invoice to the distributor, or one year from the date of the installation, or whichever occurs first. Centre Tank Services Warranty applies to all new equipment supplied or manufactured by it against defective material and or workmanship for the warranty period specified above. Should any product of the Company prove defective, we will replace free of charge provided we are notified in writing. No responsibility can be accepted by us for any charges incurred in respect of labour or incidental damage. This warranty is in substitution of every warranty as to quality fitness or description expressed or implied by stature, common law or custom. Exclusion: All hand pumps are 90 days from the date of invoice. Warranty does not cover - Damage caused by accident abuse, faulty installations, mis-application, improper maintenance, surveillance by other computer equipment or automatic fuel recording management systems, violation of product manuals, warnings, misuse of operation instructions, or acts of God. Under no circumstance shall Centre Tank Services be liable for any indirect losses, damage, consequential damage, loss of profit, loss of product, inability from use of the product for any purpose whatsoever, and all such fees and litigation. During the warranty period of 12 months. Centre Tank Services will at its own option and discretion operate a full repair or replacement of defective parts service only and arrange collection by our own transport for parts to be returned to its offices. For Commercial Pumps that are stand alone and its management systems within and during the 12 months warranty period, CTS shall at its own discretion operate the service of an Authorized Service Representative for on site repair or replacement of defective parts.

Centre Tank Services will not be held liable for any techinical information errors or equipment descriptions. The descriptions of the equipment contained within this website gives an approximate idea and does not form any part of a contract.

We have the right to terminate your access to any or all of the Services at any time, without notice, for any reason, including without limitation, breach of these Terms and Conditions. We may also at any time, at our sole discretion, discontinue the Website/Services or any part thereof without prior notice and you agree that we shall not be liable to you or any third party for any termination of your access to the Website.

You agree to comply with all applicable laws regarding the transmission of technical data exported from the United Kingdom or the country in which you reside.

The Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are protected by copyright, trade marks, patents and other intellectual property rights and laws. In accessing the Website you agree that you will access the contents solely for your personal, or commercial use. None of the content may be copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages from the Technical Section.
